General Rental Conditions of the Posterbordengigant established in Werkendam, filed on October 30, 2018 with the Chamber of Commerce of Amersfoort under number 33152576.

Article 1. Applicability

1. These rental conditions apply to all offers and agreements between De Posterbordengigant, hereinafter referred to as "the Posterbordengigant" and the hirer, unless the parties have expressly deviated from them in writing.

Article 2. Offers and agreements

1.All offers made by the Posterbordengigant are without obligation, unless expressly stated otherwise. The prices stated in an offer are exclusive of VAT.
2. The rental agreement is concluded when Posterbordengigant confirms the order in writing.

Article 3. Delivery and return

1. The rented material will be delivered and returned to the address indicated by the renter, but only to the first floor, unless otherwise agreed in writing.
2. If the hirer is not present at the delivery address at the time of delivery of the hired items, Posterbordengigant can leave the items with a note for the hirer. The latter is then considered to have signed for the delivery.
3. If Posterbordengigant is prevented from delivering as a result of force majeure, it shall be entitled to extend the delivery period by the duration of the force majeure, or to dissolve the agreement insofar as it has not been fulfilled. Force majeure means any circumstance beyond the control of Posterbordengigant.
4. If Posterbordengigant is unable to take possession of the rented items at the end of the rental period, for whatever reason, the hirer is obliged to return them to Posterbordengigant carriage paid as soon as possible.

Article 4. Cancellation

1. Cancellation of rental orders by the renter must be made " at least 3 x 24 hours before the start of the rental period. In the event of a later cancellation, 15% of the rental price will be charged as a reservation fee.
2. If a rental order is canceled by the renter after the goods have been delivered to the address specified in the order, 75% of the rental price will be charged.

Article 5. Risk and liability

1. During the rental period, all risk regarding the rented goods is with the renter. In case of theft, loss or damage of the rented goods, the renter will be charged the replacement price of the goods in question in addition to the rental fee.
2. The Posterbordengigant is not liable for the return of items that remain in the rented goods after the rental period has expired, such as the Posterborden foot plates.
3. Posterbordengigant is not liable for any damage suffered by the hirer or third parties as a result of visible or invisible defects in the rented items, unless the damage is the result of intent or gross negligence on the part of Posterbordengigant's personnel. However, if Posterbordengigant is obliged to pay damages, the liability of Posterbordengigant, regardless of the nature of the damage, is in any case limited to the rental price of the rented item that caused the damage.

Article 6. Payment

1. Payment of the rental fee shall in principle be made in cash.
2. In cases where cash payment is not required, payment must be made within 30 days of the invoice date. After the expiry of 30 days from the invoice date, the Renter shall be in default and shall owe 1% interest per month on the amount due from the date of default, or the legal interest rate if higher.
3. If the Renter is in default or violates one or more of his obligations, all extrajudicial and judicial collection costs will be at the Renter's expense. The extrajudicial collection costs shall be at least 20% of the amount due, with a minimum of €250.00.

Article 7. Disputes and applicable law

1. Contrary to the statutory rules on the jurisdiction of the civil court, all disputes between the hirer and Posterbordengigant shall be settled by the Court of Breda, if the Court has jurisdiction.
2. All agreements between Posterbordengigant and the hirer are governed by Dutch law.
